The Provincial Court has ordered a year prison sentence and 2,000 € compensation be paid.

A professor at Málaga University, named with the initials J.L.M. has been found guilty of asking for sex with a student in exchange for passing her exam paper. He told her that if she wanted a pass, she had to give him sex.

The Provincial Court in Málaga described the events as ‘unfair harassment by non-libidinal touching’ and one count of carrying out abuse during the performance of the professor’s duties. The court ordered that 2,000 € compensation be paid for moral damage suffered and handed down a year’s prison sentence.

The professor has denied any participation in the allegations, saying he had called the student to his home for an ‘oral exam’ after a colic prevented him from being in his office.

She said that on arrival at his home he closed the door, and said if she wanted to pass she would ‘have to do something’.

However the court considered that the alleged victim had been ‘sincere, coherent and probable’ and saw no spurious motives in her complaint.
